Russian Federation : Fas Passes to a Risk-oriented Approach in the Field of Antimonopoly Regulation

The Government of the Russian Federation approved the criteria for classifying the activities of legal entities and individual entrepreneurs to a certain risk category

The categorization of business for antimonopoly regulation is introduced as part of the application of the risk-based approach in the implementation of the reform of control and supervision activities.

Resolution of the Government of the Russian Federation 1 defines three categories of risk: medium, moderate and low. The category of medium risk includes trading networks with proceeds from the sale of goods of over 400 million rubles and business entities that are subjects of natural monopolies or carrying out regulated activities, with the amount of the necessary gross proceeds of more than 10 billion rubles. With respect to them, scheduled inspections can be conducted no more than once in three years.

The category of moderate risk includes business entities with revenues of over 10 billion rubles, operating in the areas of production and sales of pharmaceuticals and medical products, the provision of medical services, communication services, transportation services, housing and communal services, transportation of oil and oil products through pipelines and .P. Scheduled inspections of such organizations are conducted no more than once in five years.

In respect of economic entities, whose activities are classified as low risk, scheduled inspections will not be conducted. The cancellation of planned inspections with respect to such economic entities will reduce administrative pressure on small and medium-sized businesses.
